This Distant Sale Contract (hereinafter referred to as the "Contract") has been prepared in compliance with the Regulation on Procedure and Principle of Distance Sale Contracts, published in the Official Gazette No. 25137, dated 13.06.2003, and the provisions of the Consumer Protection Law No. 4077. It sets forth the terms and conditions governing the sale of tours, excursions, and travel services offered via electronic means and defines the rights and obligations of the parties involved.

ARTICLE 1 – SUBJECT OF THE CONTRACT

The BUYER is the individual or entity booking tours, excursions, or travel services via the SELLER’s platform. The BUYER's contact information, including name, email, and phone number, provided during registration or booking will be used for all correspondence related to this Contract.

Note: It is the BUYER’s responsibility to ensure that all information provided is accurate. Any discrepancies or errors may result in delays or issues for which the SELLER cannot be held liable.

ARTICLE 3 – INFORMATION ABOUT THE SERVICES

The tours, excursions, and services offered are as described on the SELLER’s website at the time of booking. The following details are included in the service information:

4.2 SERVICE PROVISION

The SELLER agrees to provide the service as described at the time of booking, including all agreed inclusions such as transportation, guidance, meals, and other specified benefits.

4.3 MODIFICATIONS BY THE BUYER

The BUYER may request modifications to the booking (e.g., changes to the tour date or number of participants) subject to availability and the SELLER’s policies. Additional charges may apply for such changes.

4.4 FORCE MAJEURE

If the tour or service cannot be provided due to unforeseen circumstances (e.g., adverse weather conditions, natural disasters, or force majeure), the SELLER will notify the BUYER promptly. In such cases, the BUYER may choose to:

Reschedule the service for a later date.

Replace the service with an equivalent alternative.

Cancel the booking and receive a full refund.

ARTICLE 5 – RIGHT OF WITHDRAWAL

5.1 WITHDRAWAL PERIOD

The BUYER has the right to cancel their booking within seven (7) days of purchase, provided the tour or service has not yet been delivered or commenced.

5.2 REFUND POLICY

Refunds will be processed within seven (7) business days of the BUYER’s cancellation request, subject to the following conditions:

Cancellations made within the allowed withdrawal period will receive a full refund.

For cancellations made after the withdrawal period but before the scheduled service, refunds will be subject to the cancellation policy specified at the time of booking.

5.3 NON-REFUNDABLE SERVICES

Certain services may be designated as non-refundable due to their nature (e.g., last-minute bookings, tickets for events with fixed dates). Such terms will be clearly communicated to the BUYER during the booking process.

ARTICLE 6 – OBLIGATIONS OF THE PARTIES

6.1 BUYER’S OBLIGATIONS

Ensure all provided information is accurate.

Arrive on time at the designated meeting points for the tour or service.

Follow all instructions provided by the SELLER or tour operators to ensure a safe and enjoyable experience.

6.2 SELLER’S OBLIGATIONS

Provide the services as described at the time of booking.

Address any issues or complaints raised by the BUYER promptly and professionally.

Notify the BUYER of any significant changes to the itinerary, inclusions, or schedule.

ARTICLE 7 – LIMITATION OF LIABILITY

The SELLER is not liable for:

Delays or disruptions caused by external factors such as traffic, weather, or third-party providers.

Personal injuries, accidents, or losses during the service unless caused by the SELLER’s negligence.

Non-performance of the service due to incorrect information provided by the BUYER.

The BUYER assumes full responsibility for adhering to local laws and regulations during the tour or excursion.

ARTICLE 8 – DISPUTE RESOLUTION

Any disputes arising from this Contract will be governed by the laws of Turkey. Jurisdiction lies with the Consumer Arbitration Committees or Consumer Courts in the SELLER’s region.

ARTICLE 9 – FINAL PROVISIONS

9.1 ACCEPTANCE OF TERMS

By completing the booking, the BUYER confirms their understanding and acceptance of all terms and conditions outlined in this Contract.
